通过访问、提交注册或使用本网站(包括相关产品或服务),您已表示您作为本社区的参与者(“您”或“用户”)已完全理解本用户协议的所有规定,同意作为用户接受并受其约束。

如果您不接受或不同意任何条款,请不要使用本网站,注册成为本网站的用户需要您明示接受本用户协议。

第一部分 原则

在使用本社区提供的任何服务或注册成为用户之前,用户应当仔细阅读并明确同意遵守本用户协议和本社区的任何其他规定。用户同意接受本用户协议的约束,并可能通过接受适用于某些特定服务的特定条款而被允许使用本社区的该等服务。本社区没有义务提供任何种类的特定服务,也可能随时中断或选择提供某些特定服务。

本社区保留对本用户协议条款进行随时更改、更新的权利。协议的任何更新都会及时地在网站上披露,本社区无义务向所有用户发出此类更新的特别通知。本社区已发布的和将来发布的协议、规则或条款将构成本用户协议的完整版本。用户在该等调整后使用或继续使用本网站的,将被视为接受更新后的协议。因此,我们建议您不时地定期检查网站公告和常见问题解答部分的通知公告。

本网站可以向未注册为用户的人提供基本的浏览和搜索服务。在任何情况下,任何人即使未经注册,通过使用此类服务也表示其同意并理解本社区不应被视为故意为其提供任何服务或与其缔结任何商业关系。

本社区由依据中华人民共和国(“中国”)的法律注册的翠盛商务咨询(深圳)有限公司(“公司”或“TradeStation中国”)所控制并运营。本社区提供的所有服务、产品和相关活动仅由公司管理,由此产生的任何法律责任或义务均由用户承担。

第二部分 注册及账户管理

1. 账户注册

为创建用户帐户或实际使用本社区所提供的网站服务,用户承诺接受本用户协议的约束后方有权登录。

用户应当提供其真实的身份信息用以注册账户,且该账户将由本社区按照相关规定进行验证和备份,否则本社区不得授权此人访问或使用网站上的服务。

2. 账户名称规则

用户应以恰当的名称注册,应遵守《互联网用户账号名称管理规定》,名称不得含有任何不当或淫秽文字,不得侵犯或涉嫌侵犯合法权益或第三方的利益。否则本社区有权拒绝甚至注销此类用户的注册。

用户应对提交至本社区的注册信息的真实性、合法性和有效性承担全部责任,不得冒充或恶意歪曲他人。否则本社区将保留对其采取立即终止其参与本社区、撤销其账户的权利,以及就由此引起的任何损失、损害或其他法律责任要求其索赔的权利。

3. 账户安全

用户应保证其注册信息的安全,包括用户名和密码,并负责对所有通过其账户进行的活动(包括但不限于信息泄露、发布或点击任何接受或提交协议的按钮等)承担责任。

用户不得共享其帐户(授权帐户管理员的情形除外)或使用他人的帐户。本社区帐户管理员可以通过用户的帐户信息来管理用户对相关服务或软件的访问或使用。

用户如果发现任何未经授权的帐户使用,应立即通知本社区的管理员。管理员将在可行的情况下尽力协助用户及时解决问题,但用户理解此类操作可能需要合理的时间,并且可能受限于相关技术、问题的复杂性等现实情况,因此本社区无法承诺每个用户提出的所有问题都能得到解决;如果问题无法解决,用户均认可此等情形下,本社区不承担责任。

4. 账户封锁、中止及注销

如果任何帐户持续性处于非活跃状态超过 12 个月未登录,并且账户下没有现存交易,本社区有权终止此类非活跃状态帐户。

如果用户存在欺诈、非法发布或销售商品、在网站上发布证券信息或违反法律、法规和本用户协议或网站规则的情形,则用户同意并授权本社区有权封锁、暂停或注销其账户。

用户的账户一经注销或终止,用户将立即失去对基于用户身份享有的由本社区所提供的任何服务的访问权限。

第三部分 服务内容

1. 基本情况

本社区与由公司的关联公司所开发的交易平台/软件产品(以下统称为“TradeStation产品”)相关,TradeStation产品授权中国的公司及其客户在中国境内使用,本社区主要为中国用户提供一个学习、讨论及给予技术支持的平台。

2. 服务范围

本社区最初向所有用户提供免费服务,包括但不限于:(a)为交易软件提供教程材料,如视频、音频、说明;(b)提供开源指导,如EasyLanguage wiki;(c)发布有关TradeStation产品的最新特性和功能的新闻、通知和信息,或在中国举办的相关当地活动;(d)提供技术服务,保障用户能够在本社区网站上发布文章、意见、评论、图片、视频、链接等;和(e)其他信息服务(如搜索、浏览功能等)

在适用法律未禁止的最大范围内,本社区保留不时调整或升级服务范围和内容的权利。

如果本社区决定推出任何付费服务,或决定对任何免费服务收费,均将通过公告通知用户,并提供此类收费服务的特定协议或规则。

用户同意本社区所提供的服务仅依其当前所呈现的现有状况提供,因使用任何服务而产生的或引起的任何费用应仅由您,即用户承担,包括但不限于硬件费用、软件、因使用硬件或软件产生的失误、税收等费用。

3. 服务的变更、中断或终止

鉴于网络服务的特殊性(包括但不限于服务器的稳定性问题、恶意的网络攻击等行为的存在及其他本社区无法控制的情形),或因对本网站定期或不定期维护的需要,用户同意本社区有权在需要时中断或终止部分或全部的本社区服务。若发生该等中断或中止本社区服务的情形,本社区将尽可能及时地通过网页公告、系统通知、私信、在线提醒或其他合理方式通知受到影响的用户。

如发生下列任何一种情形的,本社区有权根据本用户协议随时中断或终止向用户提供本用户协议项下的任何服务而无需对用户或任何第三方承担任何责任,由此造成的损失由用户自行独立承担:

a. 用户提供的个人资料不真实。

b. 用户违反法律法规国家政策或本用户协议规定的。

c. 用户侵犯自然人或单位合法权益的,包括但不限于侮辱、诽谤、谩骂公民个人,诋毁单位商誉或信誉等。

d. 用户损害监管部门、国家机关及政府形象。

e. 用户以任何方式损害本社区及其关联公司的商誉或信誉等合法权益。

f.  其他本社区认为需要中断或终止向用户提供本社区服务的。

第四部分 用户责任及禁止性行为

用户在本社区网站上所进行的任何活动均应当遵守本网站的相关规定,遵守中国的法律法规。用户应自行承担其因在本社区网站上进行一切活动所直接或间接引起的一切法律责任。同时用户理解互联网服务是无国界的,其同意并承诺其已遵守所在地管辖适用的所有关于网络行为及内容之法律法规。

用户承诺并同意遵守以下规定,不得利用本社区制作、上传、复制、发布、传播或者转载如下内容:

a.  违反中国宪法确定的基本原则的;

b.  危害国家安全,泄露国家秘密,颠覆国家政权,破坏国家统一的;

c.  损害国家荣誉和利益的;

d.  煽动民族仇恨、民族歧视,破坏民族团结的;

e.  煽动非法集会、结社、游行、示威,聚众扰乱社会秩序的;

f.   破坏国家宗教政策,宣扬邪教和封建迷信的;

g.  散布谣言,扰乱社会秩序,破坏社会稳定的;

h.  散布淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪的;

i.   侮辱或者诽谤他人,侵害他人合法权益的;

j.   以非法民间组织名义活动的;

k.  包含种族、肤色、性别、性取向、宗教、民族、地域、残疾、社会经济状况等歧视内容的言论和消息;

l.   发布含有法律行政法规禁止的内容的;

为了更好地管理本社区并提供更令人愉快的服务,禁止用户从事,且用户同意将不从事下列行为:

a.  未经公开报道未经证实的消息;

b.  制作、复制或传播以下信息:

  1. 可能妨害第三方权益的信息,包括但不限于病毒代码、黑客程序、软件破解注册代码;
  2. 涉及他人隐私、有意模仿他人注册名发布的信息;
  3. 破坏网站秩序或侵害网站及论坛利益的其他内容(如发布大量重复且背离主题的信息);

c.  抄袭及剽窃他人的作品。用户使用任何他人作品时应当适当地引用及注明出处;

d.  未经本社区许可,不得以任何方式发布、制作、复制或转发下列广告信息,包括但不限于:

  1. 任何第三方通过具有明示或暗示的任何形式的广告促销、交易、服务、促销,如活跃的帖子、评论、私人信息、收费阅读链接、QR码等;
  2. 任何链接、微信QR码、微信公用号、微信群号、QQ号码、QQ群或任何其他第三平台的联系方式;
  3. 本社区确定的任何其他营销或商业促销信息。

用户承诺,任何在本社区帐户下进行的活动将坚决遵守“七条底线”,即遵守包括法律法规、社会主义制度、国家利益、公民合法利益、公共秩序社会道德和信息真实性的底线要求。

本社区或其授权人员有权检查和监督任何因违反上述规定滥用本网站的行为,并有权采取一切必要的措施(包括但不限于要求用户改正行为,直接更改或删除用户发布的内容,暂停或注销用户在本社区的账户)以减轻该等不当行为所造成的影响。

第五部分 知识产权

本社区是一个信息共享的平台,其基本原则是鼓励所有用户产生创造性的想法和内容,尊重他人的知识产权。

本社区在网站上提供或显示的任何Logo、布局设计、印刷方法、文本、图像、图形等均受相关法律保护。未经相关权利所有人(包括本社区和其他原始权利人)的同意,第三方不得复制、修改、改编、翻译、解释、发布或转让此类信息。

用户承诺并保证其在本社区发布的文字、音频、视频、图片、图表等任何内容均应由用户原创或已获得合法授权并且该内容不会侵犯任何第三方的合法权益。如任何以用户在本社区发表的信息或内容存在侵权提出索赔或投诉的,用户同意本社区有权审查这些证明材料并自行决定是否对疑似侵权的帖子或账户采取任何必要行动,此类用户应对此类侵权行为的法律后果承担全部责任。

用户确认并同意其注册本社区或使用本社区提供的服务时,即表明用户授予本社区获得其所上传、发布的全部内容之免费的、非独家的、永久性的、不可撤销的权利和许可,以使用、再许可、复制、修改、显示、传输、改编、出版、翻译本网站上任何用户上传、制作、发布、转载的任何材料创作衍生作品及分发该等材料。

本社区及其授权人员有权但无义务对用户发布的内容进行审核,有权根据相关证据结合法律法规(如《侵权责任法》、《信息网络传播权保护条例》等)和本用户协议的约定代表用户处理侵权索赔主张。

第六部分 侵权举报

1. 处理原则

本社区作为一个信息发布、分享及获取的社区,高度重视自由表达和个人、企业合法权利的平衡的网络社区,删除违法信息是本社区的法定义务。

2. 受理范围

本社区接受与侵犯企业或个人在本社区中的合法权利有关的侵权报告,包括但不限于侵犯个人隐私、造谣和诽谤及商业侵权。

3. 举报方式

如果个人或企业发现本社区上存在侵犯其合法权益的内容,可以先尝试与作者取得联系,并通过沟通协商解决问题。如用户无法联系到作者,或无法通过与作者沟通解决问题,可与本社区取得联系(邮箱:TSCC-Admin@TradeStation.com)。为了保证问题能够及时有效的处理,请务必提交真实、有效、完整及清晰的材料,否则投诉可能无法被受理。

4. 处理流程

由于网络社区的信息规模庞大,并非所有申请均会被受理。本社区将尽最大努力自收到举报后的7个工作日内进行处理并回复。

本社区已经删除或处理的内容,可能仍可通过搜索引擎搜索到,比如百度和Bing。这是因为搜索引擎使用自己的缓存数据对搜索结果进行返回。此类问题本社区无权也无法处理,因此请与搜索引擎服务商进行联系。

此为本社区唯一的官方侵权投诉渠道,暂不提供其他方式处理此问题。在版主系统建立后,用户也可以寻求版主的一些帮助以减少相关争议。

第七部分 免责声明

用户同意自行承担其使用本网站的全部风险。所有信息均按当前所呈现的状况提供,仅供用户参考。就任何本网站或社区代表、本网站或社区的管理员、相关人士或任何用户在本网站上发布的任何信息或声明,包括但不限于评论、意见、预测、图表、指标、理论、直接或暗示的指示,本公司、本公司关联方或其任何代理机构均不对其准确性、时效性、完整性或实用性进行认可、承担任何责任或作出保证。请您自行做好调研工作,亦可参考其他信息披露渠道(如报纸或官方网站)的信息。本社区不对依赖于该等数据或信息的全部或部分内容而造成的或引致的任何损失承担责任。

本社区自身不会从事,亦禁止任何用户从事任何形式的非法证券投资咨询活动。本网站上提供的任何交易数据、行情备忘录、讨论、通知、声明、报告或文章均不应构成或视作对任何人购买或出售任何证券的推荐、咨询或建议。

用户在本社区中发布的内容仅代表其个人立场和观点,并不代表本社区的立场或观点。对于任何用户发布的内容,或用户之间的任何交易、行为,所引起的纠纷,本社区不承担任何法律责任或连带责任。

对于因任何网络服务变更、中断、终止或网络缺陷,使得用户使用或无法使用本网站或与本网站链接的任何网站而直接或间接引致的或产生的任何索赔、损害、损失、费用、成本或责任,本社区不承担任何责任,即便用户事先已被告知存在该等损害的可能性。

对于由用户造成的任何操作错误和财产损失,包括但不限于帐户密码被盗、转错钱包地址、账户遗失等,本社区不承担任何责任。

为了方便用户使用,本网站可能包含指向其他站点的链接。用户明确同意,本社区或其参与者均不对其他用户、链接或第三方的任何名誉损害、侵犯、误导或非法行为承担责任,因前述原因而遭受损害的风险完全由用户承担。本社区对于此等不受社区控制的外部链接的任何网页上的内容不承担任何责任。

第八部分 修改及变更

本社区保留根据互联网的发展、有关法律法规及规范性文件的变化或者业务发展的需要,而对本用户协议的条款作出修改或变更的权利。一旦本用户协议的内容发生变动,本社区将会直接在本社区网站上公布修改之后的用户协议内容,该等公布行为一经作出则视为用户已接收到修改内容的通知。本社区也可采用电子邮件或私信的传送方式,将本用户协议的修改、服务变更或其它重要事项通知用户。

如果不同意本社区对本用户协议相关条款所做的变更,用户应当停止使用本社区。如果用户继续使用本社区,则视为用户接受本社区对本用户协议相关条款所做的修改。

第九部分 通知与送达

用户理解并同意,本社区可能会通过包括但不限于软件页面提示、网站公告、系统通知、官方管理账号通知(公开或者私下的)、电子邮件、手机短信、站内信等通知方式中的一种或多种向用户送达相关通知、提示等信息。通知成功发出时,即被视为已成功送达用户。

用户理解并同意,由于电子邮箱地址、手机号码及通讯地址等信息错误或因其他不可归咎于本社区的原因,导致任何未能收到相关规则、通知、提示及其他信息的情形的,均不影响该等通知对用户产生法律效力。

本社区可在适用法律法规允许的范围内向用户的电子邮箱地址、手机号码、第三方账号等发送商业性电子信息(包括但不限于商业广告等)。用户访问或使用本网站的,即视为同意该等发送事宜。

第十部分 其他事项

本用户协议的履行、解释及争议的解决均应适用中国法律。如无相关法律规定的,则应参照通用国际商业惯例和/或行业惯例。与本用户协议有关的争议由公司注册地法院专属管辖。

如本用户协议中的任何条款无论因何种原因完全或部分无效或不具有可执行性,本用户协议其余条款的可执行性应不受影响。

本用户协议解释权及修订权归公司独家所有。


USER GUIDELINES OF TRADESTATION CHINA COMMUNITY

SPECIAL REMINDER:

Prior to using any service supplied by TradeStation China Community (the “Community”) on or through the website of the Community (https://www.tradestationchina.com.cn, the “Website”), please carefully read this User Guidelines of TradeStation China Community (the “Guidelines”) and make sure that you have fully understood all provisions set forth herein, especially the bolded and capitalized provisions of exemptions or limitation of liabilities, dispute resolutions, users’ obligations, and responsibilities.

By accessing, submitting your registration or using the website (including the associated products or services), you have indicated that you have fully understood all the provisions of, and have agreed to accept and be subject to, the Guidelines as a user or participant (“you”, “a user” or “users”) of the Community.

If you do not accept or agree with any of the provisions, please do not use the Website. The registration as a user requires your express acceptance of the Guidelines.

PART 1: PRINCIPLES

Before using any services supplied by the Community or registering to be a user, users shall carefully read and expressly agree to be subject to the Guidelines and any other rules of the Community. Users agree to be bound to the Guidelines, and may be allowed to use certain special services supplied on the Website by accepting specific terms that apply to any such special services. The Community is not obligated to provide any special services of any kind and may discontinue any or does choose to provide at any time.

The Community reserves the right to change and update provisions of the Guidelines at any time. Any updates will be timely disclosed on the Website and it’s not obligatory for the Community to give special notice to all users separately for such updates. Any guidelines, rules or terms announced, or to be announced, by the Community, will constitute the whole version of the Guidelines. By using or continuing to use the Website after the announcement of such changes, users are deemed to accept the new guidelines. Therefore, we recommend you regularly check the notices on the announcements and FAQ sections of the Website from time to time.

The Website may provide basic browsing and searching services even for unregistered persons. Under any circumstances, anyone who uses such services, even if not registered, indicates by such use that such person agrees and understands that the Community shall not be deemed as intentionally supplying any services or being engaged in any commercial relationships with such person.

The Community is controlled and operated by [翠盛商务咨询(深圳)有限公司] (the “Company” or “TradeStation China” ), duly cooperated in accordance with the laws the People’s Republic of China (“PRC”). All services, products, and related activities provided by the Community are only hosted by the Company, and any legal liabilities or obligations arising therefrom shall be solely borne by the user.

PART 2: REGISTRATION AND ACCOUNT MANAGEMENT

  1. Registration

To create a user account, or to actually use services on the Website provided by the Community, users are committed to being bound to the Guidelines and then have the right to log into the Community.

It’s a condition that the user shall provide his or her real identity information to register an account, which will be used for verification and backup by the Community in accordance with relevant regulations, otherwise, the Community cannot authorize such person to have access to, or use of, the services on the Website.

2. Rules for user names

Users shall register with proper names, complying with Regulation of Internet User Account Names (in Chinese “《互联网用户账号名称管理规定》”), which shall not contain any improper or obscene words, shall not infringe or be suspected of infringing the legitimate rights and interests of a third party. Otherwise, the Community retains the right of disapproving, rejecting, or even canceling the registration of such users.

Users shall be solely responsible for the authenticity, legality, and validity of the registered information in the Community, shall not impersonate anyone, or maliciously misrepresent themselves. Otherwise, the Community reserves the right to immediately terminate their participation, to withdraw their accounts, and reserves the rights of claiming remedies for any injury, damages or other legal liability arising therefrom.

3. Account Security

Users shall keep their registry information safe, including user names and passwords, and be responsible for all activities (including but not limited to information disclosure, posting, or clicking on any buttons of accepting or submitting any agreements, etc.) via their accounts.

Users may not share their account information (except with an authorized account administrator) or use another person’s account. The Community account administrator may use users’ account information to manage their use and access to services and software.

Users should notify the administrators of the Community immediately if they become aware of any unauthorized use of their accounts. The administrator will try to assist the user to resolve the problems in a timely manner, to the extent feasible, but users understand that such actions may take a reasonably long amount of time, and may be limited by the relevant technology, complexity of the issue, and other realities of the situation, etc., so the Community cannot promise that all issues raised by every user can be resolved, and all users accept that the Community does not have liability if the issues cannot be resolved.

4. Account blocking, suspension, and termination

If any account remains continuously inactive and has not been logged in for over 12 months, and there are no existing transactions under it, the Community reserves the right to terminate such an inactive account.

Users agree and authorize the Community to block, temporarily suspend, or cancel their accounts if they commit any fraud, illegal posting or selling of goods, publishing securities information on the Website, or violation of laws, regulations, and rules of the Website or of the Guidelines.

Upon the cancellation or termination of their accounts, users will immediately lose their access to any services supplied by the Community based on their user identity.

PART 3: SERVICES

1. Overview

The Community is about some trading platforms/software products (collectively “TradeStation products”) which have been developed by the Company’s affiliates, and licensed to Chinese firms to be used in China by such firms and their customers,  and mainly serves users of TradeStation products in China with a platform for learning, discussion, or technology support.

2. Service scope

The Community originally supplies free services to all users, including but not limited to: (a) providing educational and tutorial materials for trading software, such as videos, audios, instructions; and (b) providing open-source instructions, such as EasyLanguage wiki; (c) releasing news, notices and information about latest features and functions of TradeStation products, or any relevant local events held in China; (d) providing the technical service for users to post their articles, opinions, comments, pictures, videos, linkages and such on the Website of the Community; and (e) other informational services (i.e., searching, browsing, etc.)

To the fullest extent not prohibited by applicable law, the Community reserves the right to adjust or upgrade the scope and contents of services, at any time, and from time to time.

If the Community decides to launch any paid services, or decides to charge on any services that were free, it will notify users by announcement, and provide specific agreements or rules of such charged services.

Users agree that all services are provided by the Community on an “as is” and “as available” basis, and any expenses caused by or arising from use of any services shall be borne by solely by you, the users, including but not limited to the expense of hardware, software, mistakes made using the hardware or software, taxation, and so on.

3. Service changes, interruption, or termination

Due to the nature of Network Services (including but not limited to, server stability issues, malicious cyberattacks, and other actions beyond the control of the Community), or the need to perform regular or irregular maintenance of the Website, users agree that the Community has the right to interrupt or terminate part or all services at any time if necessary. The Community will notify affected users as promptly as reasonably possible through web announcements, system notifications, private messages, online alerts, or other reasonable means when such measures are taken.

In any of the following circumstances, the Community reserves the right to suspend or terminate any services to the user under the Guidelines at any time without any liabilities, and all damages or losses shall be borne by a user who:

a. intentionally or unintentionally provides false personal information.

b. violates laws and regulations, national policies or rules set forth in the Guidelines.

c. infringes upon the legitimate rights and interests of natural persons or enterprises, including but not limited to insulting, slandering, scolding individual citizens, and denigrating the reputation of the enterprises.

d. disdains the administrative authorities, state agencies, and governments.

e. in any way impairs the legitimate rights and interests of the Community and its affiliates.

f. other circumstances for which it is necessary to interrupt or terminate the service, as decided by the Community.

PART 4: Users’ responsibility and prohibited activities

All activities conducted by the user of the Website shall fully comply with rules of the Community and provisions of PRC laws and regulations. Users accept full responsibility for any legal liabilities directly or indirectly via their activities. Meanwhile, users understand that internet services are borderless, and thus agree to comply with all laws and regulations on online behaviors and contents under the jurisdiction of their location.

Users undertake and fully agree to abide by the rules set forth herein and may not use the Community to produce, upload, reproduce, publish, disseminate or spread the following contents:

  1. Opposing the basic principles determined by the Constitution of the PRC;
  2. Endangering national security, leaking state secrets, subverting the government, and undermining national unity;
  3. Harming national honor and interests;
  4. Inciting ethnic hatred or ethnic discrimination, and undermining national unity;
  5. Inciting unlawful assembly, association, procession, demonstration and gathering crowds to disturb social order;
  6. Undermining national religious policy, promoting cults and superstitions;
  7. Spreading rumor, disturbing social order, undermining social stability;
  8. Spreading obscenity, pornography, gambling, violence, murder, terrorism or instigating others to commit crimes;
  9. Insulting or slandering others, infringing upon the legal rights and interests of others;
  10. Organizing or carrying out activities of illegal organizations;
  11. Discrimination by race, color, gender, sexual orientation, religion, ethnicity, geographic origin, disability, or social status;
  12. Posting content prohibited by laws and administrative regulations;

In order to keep better management of the Community and offer more enjoyable services, users are prohibited from, and agree not to engage in, the following acts:

  1. Spreading news that has not been approved or publicly reported;
  2. Producing, reproducing, or spreading the information that:
    1. may harm the rights and interests of a third party by any means, including but not limited to virus codes, hacking procedures, and software cracking codes.
    1. may compromise the privacy of others, or catfishing, maliciously impersonate others;
    1. may undermine the good order of the Website or harming the interests of the Community (i.e. posting mass repetitive or off-topic information);
  3. Plagiarizing and copying the works of others. Users shall properly quote or cite the sources when using any works of others;
  4. Without the permission of the Community, none of the following advertising information shall be posted, produced, reproduced, or followed by any means, including but not limited:
    1. Any form of advertising of expressive or implicative meaning of sale, trading, service, promotion of any third-party, such as active postings, comments, private messages, charge reading links, QR codes, etc.
    1. Any links, WeChat QR codes, WeChat public numbers, WeChat group number, QQ numbers, QQ groups, or any other third-platform contacts;
    1. Any other marketing information or commercial promotions identified by the Community.

Users undertake that any activities conducted under their accounts of the Community will firmly comply with “Seven-bottom lines,” which includes bottom requirements under laws and regulations, socialist system, state interests, legitimate interests of citizens, public order, social morality, and information authenticity.

The Community or its authorized person has the right to inspect and monitor any misuse of the Website for violation of the above rules and sits with the right to take any necessary measures (including, but not limited to, urging such users to correct their behaviors, directly changing or deleting the contents posted, blocking, suspending or even terminating their accounts) to mitigate the impact of their misconduct.

PART 5: INTELLECTUAL PROPERTY RIGHTS

The Community is a sharing and informational platform with a basic principle of encouraging creative thoughts and content produced by all users, and the Community respects the intellectual property rights of others.

Any logos, layout designs, typographical methods, texts, images, graphics, etc. provided or displayed on the Website by the Community are protected by intellectual property rights under the relevant laws. Without the consent of the relevant rights owners (including the Community and other original rights holders), a third-party is not allowed to reproduce, modify, adapt, translate, interpret, publish or transfer such information.

Users undertake and warrant that any content posted by them, such as text, audio, video, pictures, graphics, etc. shall be originally created by themselves, or duly authorized to make such posting, which will not infringe any legitimate rights and interests of a third-party. If any claims or complaints of such infringement are raised, users agree that the Community has the right to review those evidential materials and decide by its own discretion whether to take any necessary actions regarding their suspicious posting or accounts, and such users shall be solely responsible for the legal consequences of such infringement.

Users confirm and agree that their registration or using services of the Community shall be deemed to grant the Community the royalty-free, non-exclusive, permanent and irrevocable right and permission to use, sub-license, reproduce, modify, display, transmit, adapt, publish, translate, create derivative works from and distribute any materials uploaded, produced, posted, reproduced by any and all users on the Website.

The Community or its authorized person has the right, but no obligation, to review all contents posted by users and has the right to deal with tort claims on behalf of any users in conjunction with laws and regulations (i.e., the Tort Liability Act, the Regulations on the Protection of the Right to Spread Information), and the Guidelines based on reviewing of relevant evidence.

PART 6: INFRINGEMENT REPORTING

1. Processing principle

The Community, as a community for information release, sharing, and access, attaches great importance to the balance between free expression and the legitimate rights of individuals and enterprises. Deleting illegal information is the statutory obligation of the Community.

2. Scope of acceptance

The Community accepts infringement reports relating to the violation of legal rights of enterprises or individuals in the Community, including but not limited to infringement of personal privacy, disdain and defamation, and commercial infringement.

3. Way of reporting

If individuals or enterprises become aware that there is any content in the Community that infringes their legitimate rights and interests, they may get in touch with the author first and solve the problem through communication and negotiation. If the users cannot contact the author, or cannot resolve the problem by communicating with the author, they may contact the Community (email: TSCC-Admin@TradeStation.com). In order to ensure that the problem can be handled in a timely and effective manner, please be sure to submit true, effective, complete and clear materials, otherwise, the complaint may not be accepted.

4. Processing

Due to the nature of the online community where mass messages are flooding, not all complaints will be accepted. The Community will try its best to process and respond within 7 working days upon receipt of the report.

The content that has been deleted or processed by the Community may still be found through search engines such as Baidu and Bing. This is because search engines such as Baidu and Bing have their own caches. The Community is not authorized to and cannot address such problems, and thus please contact relevant search engine service providers instead.

This is the only official infringement complaint channel in the Community, and other methods are not provided to handle this issue for the time being. When the moderator system has been established, users may also seek some assistance from moderators to mitigate the relevant disputes.

PART 7: DISCLAIMER

USERS AGREE THAT THEIR USE OF THE WEBSITE SHALL BE AT THEIR SOLE RISK. ALL INFORMATION IS PROVIDED ON AN “AS IS” BASIS AND FOR USERS’ REFERENCE ONLY. NEITHER THE COMPANY NOR ITS AFFILIATES OR ANY OF THEIR AGENTS ENDORSE, ASSUME ANY RESPONSIBILITY FOR, OR GUARANTEE THE ACCURACY, CURRENCY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION OR STATEMENTS POSTED ON ANYWHERE OF THE WEBSITE BY ANY REPRESENTATIVE OF THE WEBSITE OR THE COMMUNITY OR THE HOST OF THE WEBSITE OR COMMUNITY, OR AN AFFILIATED PERSON, OR ANY USER, INCLUDING, BUT NOT LIMITED TO REVIEWS, COMMENTS, FORECASTS, CHARTS, INDICATORS, THEORIES, DIRECT OR IMPLIED INSTRUCTIONS. Please do your own research and you may refer to other information disclosure channels (i.e., newspapers, or official websites). The Community shall not be held responsible for any loss caused by or resulted from reliance on such data or information in whole or in part.

THE COMMUNITY ITSELF WILL NOT CONDUCT AND PROHIBITS ANY USER FROM CONDUCTING ANY FORM OF ILLEGAL SECURITY INVESTMENT ADVISORY ACTIVITIES. ANY TRADING DATA, MARKET MEMO, DISCUSSIONS, NOTICES, ANNOUNCEMENTS, REPORTS, OR ARTICLES PROVIDED ON THE WEBSITE SHALL NOT CONSTITUTE OR BE DEEMED A RECOMMENDATION OR AN ADVISORY OR ADVICE FOR ANYONE TO BUY OR SELL ANY SECURITIES.

The content posted by users in the Community only represents their own personal positions and opinions and does not represent the positions or opinions of the Community whatsoever. The Community shall not assume any legal responsibility or joint responsibility for any disputes arising from the content produced by any users, or any transactions, behaviors of and among users themselves.

The Community shall not be held responsible or liable in any way for any claims, damages, losses, expenses, costs or liabilities whatsoever resulting or arising directly or indirectly from users’ use of or inability to use the Website or any websites linked to it due to any network services changes, interruptions,  termination or defects, even if users have been advised of the possibility of such damages in advance.

The Community does not assume any responsibility for any operation errors and property losses caused by users, including but not limited to the theft of account passwords, misplaced wallet addresses, loss, etc.

The Website may contain links to other sites for the convenience of users, and the user specifically acknowledges that neither the Community nor its contributors are liable for any defamatory, offensive, misleading or illegal conduct of other users, links, or third parties and that the risk of injury from the foregoing rests entirely with the user, and the Community shall not assume any responsibility for the content on any webpages of these external links that are not controlled by the Community.

PART 8: MODIFICATION AND CHANGES

The Community reserves the right to modify or change the terms of the Guidelines according to the development of the Internet, the changes in relevant laws, regulations and regulatory documents, or the need for business development. Once the content of the Guidelines is changed, the Community may publish the revised text directly on the Community website, and it is deemed that the user has been notified of the modifications once such an announcement is made. The Community may also use e-mail or private message transmission methods to notify the user of the amendments to the Guidelines, service changes, or other important matters.

If the user does not agree with the changes made by the Community to relevant provisions of the Guidelines, the User shall stop using the Community. If the user continues to use the Community, it is deemed that the user accepts the modification made by the Community to the terms of the Guidelines.

PART 9: NOTIFICATION AND DELIVERY

The user understands and acknowledges that the Community may adopt one or more notification methods, including but not limited to software page prompts, website announcements, system notifications, official management account notifications (publicly or privately), emails, text messages, and station letters to deliver relevant notifications or reminders to the user. When the notification is successfully sent, it is deemed to have been successfully delivered to the user.

The user understands and acknowledges that any failure to receive the relevant rules, notices, reminders and other information due to the wrong information of the e-mail address, mobile phone number, and communication address or other reasons that cannot be attributed to the Community will not affect the legal effect of such notification on the user.

The Community may, to the extent permitted by applicable laws and regulations, deliver commercial electronic information (including but not limited to commercial advertisements) to the user’s email address, mobile phone, third-party account, etc., and the users, by accessing or using the Website, consent to such deliveries.

PART 10: MISCELLANEOUS

The performance, interpretation and dispute settlement of, and arising from, the Guidelines shall be governed by the laws of PRC. If there is no relevant law, reference shall be made to general international business practices and/or industrial conventions. Disputes related to the Guidelines shall be under the sole jurisdiction of the court where the Company is registered.

If any provision of the Guidelines is invalid or unenforceable in whole or in part for whatever reason, the enforceability of the remainder of the Guidelines shall not be affected.

The right of interpretation and amendment of the Guidelines exclusively belongs to the Company.
